This agreement represents the complete agreement and understanding between Global Web Ideas LLC (“Web Site”) and the account holder (hereinafter called Customer) and supersedes any other written or oral agreement. Upon notice published online via Global Web Ideas LLC services, Global Web Ideas LLC may modify these terms and conditions, amplify them, and/or modify the prices, as well as discontinue or change services offered. If you do not agree to these terms and conditions, please notify our Billing Department (billing@globalwebideas.com) so we can initiate a closure of your account. USE OF YOUR ACCOUNT shall constitute your approval.

Disclaimer

Policies, services and prices are subject to change without prior notice. The price in effect at the time your order is received by us is the price you will be charged unless the price stated is a typo. We reserve the right to refuse service to any customer for any reason.

WE AND OUR ADVERTISERS, SUPPLIERS AND LICENSORS PROVIDE THE Global Web Ideas, LLC WEB SITE AND OUR SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS OR IMPLIED. WE AND OUR ADVERTISERS, SUPPLIERS AND LICENSORS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTY OF NON-INFRINGEMENT. SOME STATES DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING DISCLAIMER MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

WITHOUT LIMITING THE FOREGOING, Global Web Ideas, LLC SHALL NOT BE LIABLE TO YOU OR YOUR BUSINESS FOR ANY INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES OR LOST OR IMPUTED PROFITS OR ROYALTIES ARISING OUT OF THE USE OF THIS SITE OR ANY GOODS OR SERVICES PROVIDED, WHETHER FOR BREACH OF WARRANTY OR ANY OBLIGATION ARISING THEREFROM OR OTHERWISE, WHETHER LIABILITY IS ASSERTED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE AND STRICT PRODUCT LIABILITY) AND IRRESPECTIVE OF WHETHER YOU HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH LOSS OR DAMAGE. EACH PARTY HEREBY WAIVES ANY CLAIMS THAT THESE EXCLUSIONS DEPRIVE SUCH PARTY OF AN ADEQUATE REMEDY.

YOU ACKNOWLEDGE THAT THIRD PARTY PRODUCT AND SERVICE PROVIDERS MAY ADVERTISE THEIR PRODUCTS AND SERVICES ON THE Global Web Ideas, LLC WEB SITE AND THAT Global Web Ideas, LLC MAY FORM PARTNERSHIPS OR ALLIANCES WITH SOME OF THESE VENDORS FROM TIME TO TIME IN ORDER TO FACILITATE THE PROVISION OF THESE PRODUCTS AND SERVICES TO YOU. HOWEVER, YOU ACKNOWLEDGE AND AGREE THAT AT NO TIME IS Global Web Ideas, LLC MAKING ANY REPRESENTATION OR WARRANTY REGARDING ANY THIRD PARTY'S PRODUCTS OR SERVICES, NOR WILL Global Web Ideas, LLC BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY CLAIMS ARISING FROM OR IN CONNECTION WITH SUCH THIRD PARTY PRODUCTS AND SERVICES. YOU HEREBY DISCLAIM AND WAIVE ANY RIGHTS AND CLAIMS YOU MAY HAVE AGAINST Global Web Ideas, LLC WTH RESPECT TO THIRD PARTY PRODUCTS AND SERVICES, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Warranties, Errors and Omissions

We strive to provide you with the most accurate and up-to-date product and service information available. However, we are not responsible for typographical errors or technical inaccuracies on our website. Global Web Ideas LLC makes no warranties of any kind, whether expressed or implied, for the service it is providing. GlobalWebIdeas LLC also disclaims any warranty of merchantability or fitness for a particular purpose. Global Web Ideas LLC will not be responsible for damages the customer suffers. This includes loss of data resulting from delays, non-deliveries, misdeliveries, or service interruptions caused by its own negligence, subscriber's errors or omissions, or due to the fault of third parties.

Governing Law

Transactions between you and Global Web Ideas, LLC., shall be governed by and construed in accordance with the laws of the State of California, without regard to the laws regarding conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Jurisdiction

Unless otherwise specified, this website is presented solely for the purpose of promoting services available in the United States. This site is controlled and operated by Global Web Ideas, Inc. from its offices within the State of California, United States of America. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with laws governing export of software and other applicable laws, including local laws. Any litigation regarding this agreement or any transaction between customer and Global Web Ideas, LLC. shall be brought in the state or federal courts located in Santa Clara County, California and customer hereby agrees and submits to such jurisdiction and venue as proper.

Use of Services
  1. It is the responsibility of the customer to contact Global Web Ideas LLC of any changes to their account, such as phone number, address, credit card information, etc. Customers will be required to provide verification for security purposes authorizing them to make any changes to that account.
  2. Customer agrees to defend, hold harmless and expeditiously indemnify Global Web Ideas LLC from any liability, claim, loss, damage or expense arising out of the indemnifying party's breach or violation of any covenant contained in this Policy and resulting from the Customer's use of the service.
  3. Within the first 30 days as a Global Web Ideas LLC customer, if for any reason you are not completely satisfied with any of our services, we will cancel your account and refund your money for that month's service.
  4. Services provided to the Customer by Global Web Ideas LLC may only be used for lawful purposes. Transmission or publication of any information, data or material in violation of any U.S. Federal or state regulation or law is prohibited. This includes, but is not limited to, material protected by copyright, trade secret or any other statute, threatening material or obscene material, material that is with "adult content" only. Global Web Ideas LLC reserves the right to remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement. Pornography and sex-related merchandising are prohibited, including: sexual content, or direct links to adult content elsewhere. This is applies for sites that promote any illegal activity, violence or content that may be damaging to our servers or any other server on the internet. Links to such material are also prohibited. Examples of non-acceptable content or links are: Pornography, Hackers applications/archives, "Warez" sites, spam applications.
  5. Global Web Ideas LLC accounts cannot be transferred or used by anyone other than the subscriber. Customers may not sell, lease, rent or assign accounts to any party not named in this Policy.
  6. Global Web Ideas LLC reserves the right to cancel service for any reason without prior notice. In case of cancellation, unused fees may be returned to the subscriber on a pro-rata basis. Fees for domain name registration are not refundable.
  7. If a customer re-registers after Global Web Ideas LLC's cancellation of the account without Global Web Ideas LLC's written consent, Global Web Ideas LLC will cancel Customer's account and all dues and fees paid to date regardless of whether service has been rendered will be forfeited. Additionally, any amounts due will be immediately payable.
  8. Customer agrees not to transmit, promote, or otherwise make available any software, product or service that is either illegal or designed to violate this Agreement. Such software, products or services include, but are not limited to, programs designed to send unsolicited advertisements (i.e. "spamware") and services which send unsolicited advertisements.
  9. Domain name registration fees are not refundable.
  10. Additionally, CUSTOMER agrees not to utilize the Global Web Ideas LLC service, equipment or email address in connection with the transmission of the same or substantially similar unsolicited message to 50 or more recipients or eight or more newsgroups in a single day. CUSTOMERS responsible for violating this clause of the Global Web Ideas LLC Acceptable Use Policy will be fined $200 per message. Payment by CUSTOMER under this provision shall not prevent Global Web Ideas LLC from seeking other legal remedies against CUSTOMER.
  11. Global Web Ideas LLC requires that its agreements be made with a person who is qualified to contract. As such, subscriber must be over the age of eighteen (18) years. Otherwise, a parent or guardian must accept this agreement and enclose the proper payment. Global Web Ideas LLC cannot accept payments from persons who are not at least eighteen (18) years of age, nor can we accept agreements from persons who are not at least eighteen (18) years of age.
  12. Customer shall ensure that its use of Global Web Ideas LLC's network services shall not disrupt Global Web Ideas LLC, its associated networks or equipment forming part of the systems. In instances in which an excessive amount of system resources are utilized by a subscriber, Global Web Ideas LLC reserves the right to place CPU process limits on the Customer's account to prevent disruption of service to other customers. Customers shall not transmit any communication where the meaning of the message, or its transmission or distribution, would violate any applicable law or regulation or would likely be offensive to the recipient thereof. No message may be mass distributed, "broadcast," or otherwise sent on an intrusive basis to any Global Web Ideas LLC user or to any directly or indirectly attached network. Use of Global Web Ideas LLC's connection in a manner that is disruptive, damaging, unlawful, offensive, or intrusive as determined by Global Web Ideas LLC shall be considered a breach of this Policy and may result in cancellation of service. This prohibition extends to sending of unsolicited mass mailings from another service which in any way implicates the use of Global Web Ideas LLC's service, Global Web Ideas LLC's equipment or any site hosted on any Global Web Ideas LLC network.
  13. Customer warrants that any material submitted for publication on Global Web Ideas LLC does not violate or infringe any copyright, trademark, patent, statutory common law or proprietary interest of others or contain anything obscene or libelous. Global Web Ideas LLC reserves the right to remove any and all materials which infringe on copyright work. Such materials will be removed at any time upon receiving a complaint and or notice of copyright infringement.
  14. If Global Web Ideas LLC becomes aware of material that could be infringing on a third party's copyright, it will initiate an investigation. To conduct an investigation of copyright infringement, the Complainant must submit at least two items. First, Complainant must submit a claim in writing with the applicable copyright or trademark registration number and a copy of the underlying copyrighted work along with the Customer's materials. Second, Complainant must offer a good faith certification signed under penalty of perjury. This certification must state that the work is the property of the Complainant that the work has been copied and that use of the work is not defensible. With this information in-hand, Global Web Ideas LLC, at its discretion, may, at any time deny access to the challenged material of Customer.
  15. Use of other organizations' networks or computing resources is subject to their respective permission and usage policies.
  16. For all new domains, there is a yearly non-refundable registration fee. Global Web Ideas LLC will automatically pay this fee as well as all annual non-refundable renewal fees on your behalf while your Global Web Ideas LLC account is active and current. These fees will appear on your billing statement unless prior arrangements are made with our customer service department.
  17. Use of Global Web Ideas LLC's hosting services could involve listing subscriber's participation in relevant directories, and subscriber expressly grants permission for such listings.
  18. Although all hosting plans permit unlimited data transfer, each plan is subject to a surcharge in the event usage exceeds the allotted free bandwidth for that plan. Customer is responsible for charges related to bandwidth exceeding the plan's allotted data transfer. For pricing information, visit or Plan Comparison page.
  19. Transferring your domain to another provider does not constitute canceling your Global Web Ideas LLC account. You must notify Global Web Ideas LLC to formally cancel your account with Global Web Ideas LLC to avoid further charges.
  20. On occasion, Global Web Ideas LLC may have a need to communicate with its customers through email issues related to billing, as well as changes, additions and modifications to the network. It is the responsibility of the customer to check email sent to the primary login email address on the account.
  21. Any party seeking to report any other potential violations of this Agreement may contact Global Web Ideas LLC via email at abuse@globalwebideas.com.
